INDUSTRY CHECKLIST · SUBSTANCE ABUSE TREATMENT CENTERS

The substance abuse treatment center insurance checklist

QUICK ANSWER

Substance abuse treatment centers usually carry professional liability (e&o), general liability and abuse & molestation. Treatment centres manage detox and relapse risk for residents who may die in care, keep records protected by rules stricter than ordinary health privacy, and operate under licensing, accreditation and payer scrutiny that all specify insurance. The funder and the lender ask for proof of each. The checklist below covers who asks and how to check what you have.

Who asks a substance abuse treatment center for what

Who What they usually want to see
Grant funders & government contracts General liability, professional and abuse coverage at stated limits, directors and officers, and a crime bond over any funds held
Banks, lenders & SBA loans Property or auto physical damage with the lender as loss payee, and liability proof at closing and every renewal
Cities, counties & permits General liability, auto and workers' compensation at the limits in the permit or contract

Each of them wants a certificate, and most want it again at every renewal. A live certificate link from the wallet shows today's coverage to every holder and tells them when it changes.

How to check what you already have

  1. Professional liability declarations. Claims-made or occurrence, the retroactive date (it should not have moved), the limit per claim and aggregate, the deductible, and whether defence costs sit inside or outside the limit.
  2. General liability declarations page. Three liability numbers matter: each occurrence, general aggregate and the products–completed operations aggregate. Then the forms list: blanket additional insured, waiver of subrogation and primary and non-contributory wording satisfy every contract; scheduled forms satisfy one.
  3. Abuse and molestation. A separate limit, not a sublimit of general liability; whether it is occurrence or claims-made; and whether the organisation and the individual are both covered.
  4. Cyber declarations. The headline limit matters less than the sublimits: social engineering, funds-transfer fraud, ransomware and business interruption, plus the regulatory coverage and the panel of breach vendors.
  5. Workers' compensation information page. Item 3.A must list every state you work in, item 4 must carry the right class codes, and the employers' liability limits should meet what contracts ask. Check that the estimated payroll is close to this year's.
  6. Property section. Limits for building, business personal property and tenant improvements against replacement cost, the coinsurance percentage, the deductible, and whether flood and earthquake are excluded (they usually are).
  7. Directors and officers declarations. Entity coverage, employment practices if packaged, the retention, and the exclusions for prior and pending matters.
  8. Umbrella schedule of underlying insurance. Each primary policy listed with the limits the umbrella expects; a gap between the two is uninsured.
  9. Medical professional liability declarations. Each provider's retroactive date and limits, whether the entity is covered, consent-to-settle wording, and the cost of tail coverage when a provider leaves.
  10. Employment practices declarations. Limit and retention, third-party coverage for claims by customers, and whether wage-and-hour claims carry any defence sublimit.
  11. Business owner's policy declarations. Liability limits on the first page, then the property section: building (if you own), business personal property, business income and the named extras such as spoilage, equipment breakdown or employee dishonesty. Confirm the property values are current.
  12. Business income. The limit or actual-loss-sustained wording, the waiting period, the period of restoration and whether extra expense is included.

What usually goes wrong for substance abuse treatment centers

  • Overdose and suicide in residence, the severity claims of the class.
  • Confidentiality rules for treatment records breached by ordinary office practice.
  • Payer and licensing contracts that require limits higher than the policy carries, discovered at survey time.
  • A retroactive date reset when the practice changed carriers, leaving earlier treatment uninsured.
  • Tail coverage never bought for a provider who left.
  • Telehealth across state lines without the licence or the coverage to match.

What underwriters will ask a substance abuse treatment center

  • Levels of care and beds, medical staffing, accreditation and licensing, payer contracts, and records systems
  • Level of care, whether any medical procedures are performed, and staff credentials
  • Background checks, incident reporting and any state survey findings
  • Specialties, procedures performed and whether any are done under anaesthesia
  • Claims-made retroactive dates and prior-acts coverage for each provider
  • Licence types, telehealth share and whether minors are treated

Renewal timing

Workers' compensation is audited on actual payroll and liability on sales, so a busy year ends with a bill unless the estimates were kept honest; pay-as-you-go billing through your payroll company removes most of that. Renewal autopilot starts the comparison sixty days out, prefilled from the wallet.

Questions people actually ask

What claims define treatment centres?

Death in care from overdose or suicide, elopement and relapse, and abuse allegations. Professional liability written for behavioural health, with abuse coverage, is the policy; admission screening, monitoring protocols and medical oversight are the defence.

Why are treatment records different for cyber purposes?

Federal confidentiality rules for substance-use records are stricter than general health privacy, with their own consent and disclosure requirements. A breach carries both; cyber coverage with regulatory defence is standard for the class.

What do payers and licensing agencies usually require from a substance abuse treatment center?

General liability, professional liability and abuse coverage at stated limits, workers' compensation, often auto if clients are transported, and sometimes a crime bond covering client funds. Each contract's insurance section says which; the contract checker reads them for you.

What is tail coverage and when does a substance abuse treatment center need it?

Malpractice is usually claims-made: it covers claims reported while the policy is in force. When a provider leaves or the policy is cancelled, a tail (extended reporting) endorsement keeps covering claims from the old treatment. Without it, a claim filed a year later has no policy to answer it.

Does professional liability cover a licensing-board complaint?

Good policies include licensing-board defence as a separate limit, because the complaint costs legal fees even when it seeks no damages. Check that the limit exists and how large it is; it is the most used part of the policy for many clinicians.
