Matching professional liability (errors and omissions)

QUICK ANSWER

Professional liability, also called errors and omissions, covers claims that your work, advice or service fell short and cost a client money — the exposure general liability excludes. Most policies are claims-made with a retroactive date, so the comparison looks hard at those terms. Carriers rate it on your profession, revenue, contract practices and claims. CoverMatch compares limits, retentions, retroactive dates, who is insured, and the definition of professional services.

01 / WHAT UNDERWRITERS ASK
  • Exactly what services you provide and to whom
  • Annual revenue and the largest contract or project
  • Whether you use written contracts and limitation-of-liability clauses
  • Your current policy's retroactive date and limits
  • Claims and circumstances you know about that could become claims
  • Subcontractors or independent professionals who work under your name
  • Licences and certifications held
02 / WHAT MOVES THE PRICE
  • ProfessionAn IT consultant, a marketing agency and a bookkeeper carry different error exposure.
  • Revenue and largest projectMore work and bigger engagements mean larger potential claims.
  • Limit and retentionHigher limits cost more; a higher retention (the deductible you pay per claim) costs less.
  • Contract practicesWritten agreements with clear scope and liability caps earn credit with many carriers.
  • Prior acts coverageMatching your existing retroactive date keeps past work covered and is worth paying for.
Direction only — the carriers' quotes carry the figures.
03 / HAVE READY
  • Your current E&O declarations page, including the retroactive date
  • A one-paragraph description of your services and a client list by type
  • Revenue for the last year and the largest engagement
  • A sample client contract
  • Any client agreement that sets the limit you must carry

The terms that matter more than the price

Professional liability quotes differ most in wording. The definition of professional services decides whether your actual work is covered. The retroactive date decides whether past work is covered. The retention and whether defence costs sit inside the limit decide what a claim costs you. CoverMatch places each of these on its own row so a lower premium that resets your retroactive date or narrows the definition is visible before you buy.

How CoverMatch compares

Your application goes to the carriers appointed for your profession. Each quote's limits, retention, retroactive date, insured persons, territory, defence provisions and notable exclusions are read and compared with your current policy. Contract rows from your wallet — a client that requires a specific limit — are checked against each quote.

Switching carriers safely

Ask the new carrier to match your current retroactive date (full prior acts). If a quote cannot, the comparison says so and shows what tail coverage from the old carrier would mean. Never let the old policy lapse before the new one is bound.

After you buy

The policy card shows the retroactive date and limit, renewal autopilot reshops it before expiration with the current policy's retroactive date carried into the application, and certificates for clients issue from the wallet.

Questions people actually ask

What does claims-made mean?

The policy covers claims first made during the policy period, for work done after the retroactive date. Switch carriers without matching the retroactive date and earlier work loses coverage; cancel without tail coverage and claims reported later are not covered.

What is a retention?

The amount you pay toward each claim before the carrier pays, like a deductible. Many professional policies also apply the retention to defence costs.

Are defence costs inside or outside the limit?

It differs. Defence inside the limit erodes what is left to pay a judgment; outside the limit does not. The comparison states which each quote offers.

Do I need professional liability if I have general liability?

They cover different things. General liability pays for injuries and property damage; it excludes claims that your professional work caused a financial loss. Clients who hire you for expertise usually ask for both.
