STRAIGHT ANSWER

What is a waiver of subrogation?

QUICK ANSWER

Subrogation is your insurer's right, after paying your claim, to pursue whoever caused the loss. A waiver of subrogation is an endorsement in which the insurer gives up that right against a named party — your landlord, a general contractor, a client. Contracts ask for it so that your loss does not turn into a lawsuit against them. It goes on general liability, workers' compensation and sometimes property and auto policies.

Why the other party wants it

Imagine your employee is hurt on a general contractor's site and your workers' compensation carrier pays. Without a waiver, the carrier could sue the general contractor to recover what it paid. The general contractor requires a waiver so that your insurance stays your insurance. Landlords ask for the same reason after a fire or water loss.

Blanket or scheduled

A blanket waiver applies automatically to anyone your written contract requires; a scheduled waiver names one party at a time. Blanket forms make certificate requests instant, which is why CoverMatch's comparison flags quotes that include them.

Where it shows up

On the certificate, as a checkbox per policy line and a note in the description of operations citing the endorsement. In the wallet, the policy card lists blanket endorsements the extraction found, and holder requests that tick "waiver of subrogation" are approved automatically when the form is present.

Questions people actually ask

Does a waiver of subrogation cost money?

Blanket waivers on general liability are often included or inexpensive. On workers' compensation most carriers charge a small percentage of the premium for the payroll on that contract, or a flat charge for a blanket waiver.

Can a certificate show a waiver that is not on the policy?

It should not. The checkbox on a certificate is only valid when the endorsement exists; a live certificate shows the waiver only when the policy forms carry it.

Does a waiver reduce my coverage?

No. It limits what your insurer can recover from the other party after paying you; your own claim is paid the same way.
