STRAIGHT ANSWER

What does primary and non-contributory mean?

QUICK ANSWER

Primary means your liability policy responds first to a covered claim that also involves the party you contracted with. Non-contributory means your insurer will not ask that party's insurer to share the loss. Together they make sure the additional insured's own policy is untouched. The wording comes from an endorsement on your general liability policy, and the certificate should cite it.

The practical effect

When a customer is hurt in the space you lease and sues both you and the landlord, two policies could respond: yours and the landlord's. Primary and non-contributory wording means yours pays first and alone, up to its limit, before the landlord's policy is touched. The landlord's premium and loss history stay clean, which is exactly why the lease asks for it.

Where it lives

On a general liability or auto policy, as an endorsement or as part of a blanket additional insured endorsement. A certificate alone cannot create it. The description of operations on the certificate should cite the form number so the holder can verify it.

In the wallet

The policy card lists blanket endorsements found in your policy forms, including primary and non-contributory. Holder requests that need it are approved instantly when the form exists and routed to the carrier when it does not.

Questions people actually ask

Is primary and non-contributory the same as additional insured?

No. Additional insured status gives the other party coverage under your policy; primary and non-contributory decides whose policy pays first when both could. Contracts usually ask for both.

Does it increase my premium?

Usually by little or nothing when it is part of a blanket additional insured endorsement. It does mean your policy and your loss history absorb claims first.

What if my policy does not include it?

Ask the carrier for the endorsement, or compare quotes that include it as a blanket form. CoverMatch shows the endorsement status on each quote.
